Introduction

These Terms of Use & Service (“Terms”) are part of a legally binding agreement between Users (“you”, “your”) and Careem Technologies (“we”, “us”, “our”). Please refer to the ‘Definitions’ section in Part 1, below, for the meaning of any capitalised terms (including ‘Users’ and ‘Careem Technologies’) used in these Terms.

These Terms govern your use of the Careem Platform and your receipt and use of Careem Technologies Products and Services that are available through the Careem Platform. Partner Products and Services that you order through the Careem Platform will be governed by separate terms and conditions between you and the Partner. Any Partner terms and conditions must be read in conjunction with these Terms.

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING AND/OR USING THE CAREEM PLATFORM. YOUR ACCESS AND/OR USE OF THE CAREEM PLATFORM CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO BE BOUND BY [THESE TERMS, YOU MUST NOT, AND YOU ARE NOT ENTITLED TO, ACCESS OR USE THE CAREEM PLATFORM.

These Terms are set out in two parts:

  • Part 1 – General Terms

  • Part 2 – Product and Service Specific Terms


In addition, supplemental terms may apply to certain Careem Technologies Products and Services, such as policies for a particular event, loyalty program, activity or promotion. Such supplemental terms will be disclosed to you in connection with the applicable Careem Technologies Products and Services. Supplemental terms are in addition to, and shall be deemed part of, the Agreement between you and Careem. Supplemental terms shall prevail over these Terms in the event of a conflict between the supplemental terms and these Terms…

We may amend the Terms from time to time. Any amendments made by us will be effective upon posting an updated version of the Terms on the Careem Platform or otherwise making the amended terms available to you. Your continued access or use of the Careem Platform constitutes your agreement to be bound by these Terms, as amended.

PART 1 – GENERAL TERMS



Definitions

Account” means an account that a User creates to access and use the Careem Platform and the Products and Services made available through it.
Affiliate” means, in relation to Careem, any entity that directly or indirectly controls, is controlled by, or is under common control with Careem Technologies.
Benefits” means any benefits offered to Users who are subscribed to Careem Plus from time to time.
Captain” means an independent contractor who delivers meals, products, goods and/or groceries ordered through the Careem Platform.
Careem Technologies” means Careem Deliveries FZ LLC and its Affiliates.
Careem Bike” means the bike rental service provided (or made available) by Careem Technologies, as more particularly described in Part 2 of these Terms.
Careem Bundle” means a bundle of Careem Credit.
Careem Credit” means the prepaid balance which is represented electronically, denominated in your local currency and attributed to your Account.
Careem Fee” means any fee payable in respect of orders for Products and Services placed through the Careem Platform, other than Charges.
Careem Pay” means the payment service provided (or made available) through the Careem Platform, as more particularly described in Part 2 of these Terms.
Careem Platform” means the digital network (and each component thereof) that Careem Technologies makes available as a marketplace for Users to order Products and Services. It includes the Careem Technologies website available at [www.careem.com] and the software applications made available for download by Careem Technologies, in each case as updated or upgraded from time to time.
Careem Plus” means the subscription product provided (or made available) by Careem Technologies, as more particularly described in Part 2 of these Terms.
Careem Technologies Products and Services” means Products and Services that are available through the Careem Platform and are provided to you by Careem Technologies.
Charges” means the charges payable by you for Products and Services you order through the Careem Platform.
Competition” means any competition, contest or giveaway conducted by Careem Technologies from time to time.
Competition Winner” means an individual who wins a Competition.
Content” means any text, audio, video, images, graphics, software or other information or data.
DineOut” means the dine out discovery platform provided (or made available) by Careem Technologies, as more particularly described in Part 2 of these Terms
"Dispute" means any dispute, claim or controversy arising out of, or in connection with, the (including the use of the Careem Platform and/or the receipt or use of Products and Services).
Entrant” means an individual who enters into a Competition.
Food” means the food product/service provided (or made available) by Careem Technologies, as more particularly described in Part 2 of these Terms.
Loss” means, together, any loss, damage, liability, cost, expense and charge, and “Losses” shall be construed accordingly.
Loyalty Program” means the loyalty program made available by Careem Technologies, as more particularly described in Part 2 of these Terms.
“Order” means a request by a user to purchase any meals, groceries, goods or services from Careem Technologies and/or its Partner(s) through the Careem Platform (as appropriate given the context).
Off-App Merchants” means Third Parties who sell goods, services or products to you other than through the Careem Platform.
Prize” means a prize that made available in connection with a Competition from time to time.
Participating Organisation” means an organisation, present on the Careem Platform, that Careem Technologies has partnered with to help support our communities which may include: Government entities, NGOs and other charitable organisations.
Partner” means a Third Party who lists and makes available their Products and Services on the Careem Platform.
Partner Products and Services” means all Products and Services that are available through the Careem Platform, other than Careem Technologies Products and Services. Partner Products and Services are provided by a Partner of Careem Technologies, not Careem Technologies.
Products and Services” means all products and services that are available through the Careem Platform from time to time.
Promo Code” means any alpha numeric code that Careem Technologies makes available to you in connection with a promotion from time to time.
Service Promotion” means a service promotion made available through the Careem Platform from time to time.
Third Party” means any natural person, corporate or unincorporated body (whether or not having separate legal personality), other than you and Careem Technologies. For the avoidance of doubt, this may include other Users, and/or Captains.
Users” means any individual who accesses or uses the Careem Platform.

1. Careem Platform

The Careem Platform provides a digital network which functions as a marketplace for Users to access and order Products and Services.

Subject to your compliance with the Terms, we grant you a limited, non-exclusive, non-sub-licensable, revocable, personal, non-transferrable license to: (i) access and use the Careem Platform on your device solely in connection with your use of the Careem Platform; and (ii) access and use any Content owned by or otherwise licensed to Careem Technologies that may be made available on the Careem Platform, in each case solely for your non-commercial use. Any rights not expressly granted herein are reserved by us and our licensors.

The Careem Platform and all rights therein are and shall remain our property or the property of our licensors. Neither the Terms nor your use of the Careem Platform convey or grant to you any rights: (i) in or related to the Careem Platform, except for the limited license granted above; or (ii) to use or reference in any manner Careem’s company names, logos, product and service names, trademarks or services marks, or those of Careem’s licensors.

2. User Account

Each User must create an Account. Unless otherwise permitted by Careem Technologies in writing, you may only possess one Account.

The Careem Platform is not available for use by persons under the age of 18 and/or individuals who cannot form legally binding contracts under applicable law. If you are not over the age of 18 and/or are not able to form a legally binding contract by law, you are not entitled to use, and must immediately discontinue your use of, the Careem Platform.

Account registration requires you to submit to Careem Technologies certain personal information, such as your name, address, mobile phone number. Inclusion of other personal information may be required at a later stage or in relation to specific Products and Services. You agree to ensure that all information that you submit to us is accurate and correct at the time you provide it. You also agree to maintain accurate, complete, and up-to-date Account information. Your failure to maintain accurate, complete, and up-to-date Account information may result in your inability to access and use the Careem Platform, including your ability to request access to your personal information or to opt in or out of marketing preferences. It may also result in Careem Technologies terminating the Terms with you and deleting your Account.

You agree to maintain the security and secrecy of your Account username and password at all times. You may not authorize third parties to use your Account, and you are not entitled to assign or otherwise transfer your Account to any other person or entity.

You agree and understand that you are responsible for all activity that occurs under your Account, even as a result of loss or theft of the device through which you access the Careem Platform. Careem Technologies will treat all activity that occurs under your Account as though it was done by you. Careem Technologies and its Affiliates expressly disclaim any liability arising from the unauthorized use of your User Account and you agree that Careem Technologies and its Affiliates shall not be liable to you for any Loss you suffer arising out of, or in connection with, any unauthorized use of your User Account.

Should you suspect that any Third Party may be using your Account, or you suspect any other breach of security, you must notify us immediately.

3. Use of Careem Platform and/or Products and Services

In certain instances, you may be asked to provide proof of identity to access or use certain Products and Services on the Careem Platform. You agree that you may be denied access to, or use of, those Products or Services or the Careem Platform if you refuse to, or are unable to, provide proof of identity.

You may not access and use the Careem Platform for any purpose other than the purpose for which Careem Technologies makes it available. You must comply with all applicable laws and regulations when using the Careem Platform and the Products and Services available through the Careem Platform. You shall not use the Careem Platform and/or such Products and Services in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the Terms.

In relation to your use of the Careem Platform and/or the Products and Services you must comply with any acceptable use policy and other instructions issued to you by Careem Technologies from time to time. In particular, you must not at any time:

  • impersonate any Third Party;

  • stalk, threaten, or otherwise harass any Third Party (including other Users or Captains), or carry any weapons;

  • violate any law, statute, rule, permit, ordinance or regulation;

  • interfere with or disrupt the Careem Platform (or the servers or networks connected to the Careem Platform) or the Products and Services;

  • post information or interact on the Careem Platform in a manner which is false, inaccurate, misleading (directly or by omission or failure to update information), defamatory, libelous, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, or illegal;

  • Use the Careem Platform or the Careem Technologies Products and Services to transport, facilitate the sale of or otherwise deal in: narcotics, alcohol or other illegal substances, goods, or items;

  • use the Careem Platform or the Products and Services in any way that infringes any Third Party’s rights, including but not limited to: copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;

  • post, email or otherwise transmit any malicious code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, or surreptitiously intercept or expropriate any system, data or personal information;

  • forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Careem Platform or the Products and Services;

  • “frame” or “mirror” any part of the Careem Platform or the Products and Services, without our prior written authorization, or use meta tags or code or other devices containing any reference to us in order to direct any Third Party to any other web site for any purpose;

  • modify, adapt, translate, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Careem Platform, any Content on the Careem Platform, or the Products and Services;

  • rent, lease, lend, sell, redistribute, license or sublicense the Careem Platform or the Products and Services (or access to any portion of the Careem Platform or the Products and Services);

  • use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, scrape, “data mine”, or in any way reproduce or circumvent the navigational structure or presentation of the Careem Platform, any Content on the Careem Platform, or the Products and Services;

  • link directly or indirectly to any other web sites;

  • transfer or sell your User Account, password and/or identification to any Third Party;

  • discriminate against or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation or otherwise cause nuisance, annoyance, inconvenience, or property damage to any Third Party; or

  • cause any Third Party to engage in the restricted activities above.

4. Suspension or Removal of Careem Platform and/or Your Account

We do not guarantee that the Careem Platform, or any Content on it, will always be available or be uninterrupted. Careem Technologies may suspend, withdraw or restrict the availability of all or any part of the Careem Platform, or any Content on it, for business and operational reasons without liability at any time, with or without notice. Where practicable, we will try to give you reasonable notice of any suspension, withdrawal or restriction.

Careem Technologies reserves the right to suspend or delete your Account, and to terminate your right to access and use the Careem Platform, without liability at any time, for any reason, with or without notice. In the event you fail to comply with the Terms, we may take any action we deem necessary. This may include, but is not limited to, any
of the following:

  • immediate, temporary or permanent, suspension or withdrawal of your Account and/or your right to use the Careem Platform;

  • taking legal action against you, including proceedings for reimbursement of all Losses Careem Technologies suffers (including, but not limited to, reasonable administrative and legal costs) as a result of your failure to comply with the Terms;

  • disclosure of such information to law enforcement authorities as we feel is necessary; and/or

  • immediate, temporary or permanent, removal of any Content uploaded by you to the Careem Platform.

5. Content

We aim to update the Careem Platform regularly and reserve the right to change the Content on the Careem Platform without liability at any time, for any reason, with or without notice.

Whilst we aim to update the Careem Platform regularly, the Content on the Careem Platform may be out of date at any given time. Certain Content on the Careem Platform may also include information and materials provided by Third Parties that has not been verified or approved by Careem Technologies. The inclusion of any information and materials provided by Third Parties on the Careem Platform should not be considered to be an approval or endorsement by Careem Technologies of that information and material. You acknowledge and agree that your access and use of such information and material is entirely at your own risk.

Some of the Content available on the Careem Platform may contain advertising and promotional information and material that has been provided to Careem Technologies by Third Parties. In relation to such advertising and promotional information and material, responsibility for ensuring that all necessary licences, consents and permissions have been obtained and/or for ensuring that the advertising and promotional information and material complies with applicable law and regulation lies solely with the Third Party that provided the advertising and promotional information and material to Careem Technologies. Careem Technologies does not assume any liability to you or others in relation to the same.

You acknowledge and agree that all Content on the Careem Platform is made available to you for information purposes only. Careem and its Affiliates make no representation, and give no warranty or guarantee, that the Content on the Careem Platform is accurate, complete or up-to-date. You should not rely on any such Content without first independently verifying its accuracy and completeness. Careem Technologies and its Affiliates disclaim all liability to you in connection with your use of, or reliance on, the Content available on the Careem Platform, and you agree that Careem Technologies and its Affiliates shall not be liable to you for any Loss you suffer arising out of, or in connection with, any Content on the Careem Platform (including your reliance on it).

Where the Careem Platform contains links to other websites provided by Third Parties, these links are provided for your information only and Careem Technologies has no control over the Content of these sites. Any links to other websites made available on the Careem Platform should not be considered to be an approval or endorsement by Careem Technologies of those websites (or the Content available on them). You acknowledge and agree that your access and use of such websites (and the Content available on them) shall be governed by the terms and conditions of the website owner and is entirely at your own risk.

6. Products and Services

There are two types of Products and Services available through the Careem Platform - the differences between the two is explained here and in more detail in relation to each service in Part 2 :

A. Careem Technologies Products and Services

Careem Technologies Products and Services are identified as such in Part 2 of these Terms and are provided to you by Careem Technologies. Your receipt and use of Careem Technologies Products and Services is governed by an Terms between you and Careem Technologies.

When you place an Order for a Careem Technologies Product or Service, you are offering to buy that product or service from Careem Technologies. Careem Technologies will either accept your order or request for service and provide you with the relevant products or services, or reject your order or request for service. If Careem accepts your order or request for service, an agreement will be formed between you and Careem Technologies.

From the point at which Careem Technologies accepts your order, you will be committed to purchase the Careem Technologies Product and/or Service in accordance with the Terms. Unless otherwise agreed with Careem Technologies in writing, you will not be able to change or cancel your order or service.

From time-to-time, circumstances arise which mean Careem Technologies has to cancel an orders after it has been accepted. If such circumstances arise Careem Technologies will notify you that your order or service is cancelled and refund any Charges paid by you in relation to the cancelled Careem Technologies Products and/or Services. You acknowledge that Careem Technologies reserves the right to cancel Orders for Careem Technologies Products and Services after they have been accepted and agree that Careem Technologies and its Affiliates will have no liability to you in connection with any cancelled order placed by you or requested service, other than to refund any Charges you have paid for the cancelled Careem Technologies Products and Services.

YOU ACKNOWLEDGE THAT NEITHER CAREEM TECHNOLOGIES NOR ITS AFFILIATES OWN ANY VEHICLES FOR TRANSPORTATION,OR LOGISTICS AND THAT, ALL SUCH SERVICES ARE PROVIDED BY INDEPENDENT THIRD PARTY CONTRACTORS, WHO ARE NOT EMPLOYED BY CAREEM TECHNOLOGIES OR ANY OF ITS AFFILIATES. YOU FURTHER ACKNOWLEDGE AND UNDERSTAND THAT WHERE CAREEM IS PROVIDING ‘DELIVERY SERVICES’, ITS RELATIONSHIP WITH THE INDEPENDENT THIRD PARTY CONTRACTOR IS LIMITED TO THAT OF A CONTRACTOR-SUBCONTRACTOR RELATIONSHIP. THIS DOES NOT IN ANY WAY IMPLY AN EMPLOYMENT RELATIONSHIP BETWEEN CAREEM AND THE SUBCONTRACTOR.


B. Partner Products and Services

Unless Careem Technologies notifies you otherwise, all Products and Services not identified as Careem Technologies Products and Services in Part 2 of these Terms are Partner Products and Services. This includes, but is not limited to, any Products and Services you order in respect of the following:

  • Ride Hailing

  • Food

  • Home Cleaning

  • Wellness

  • Tickets

  • Laundry

  • Flowers

  • Pharmacy

  • Salon and Spa

  • Car Rental

  • Supermarkets


Part 2 of these Terms explains the circumstances in which certain Products and Services will be Partner Products and Services, rather than Careem Products and Services.

Whilst Careem Technologies endeavours to ensure that your experience when ordering Partner Products and Services through the Careem Platform is a pleasant one, Careem Technologies simply acts as a facilitator between you and the Partner by managing your experience throughout the order process. It is important that you understand that Careem Technologies does not verify the quality of Partner Products and Services, nor the reliability of any Partner who lists Partner Products and Services on the Careem Platform.

All Partner Products and Services are provided to you by Careem Technologies Partners. Your receipt and use of all Partner Products and Services is governed by a separate agreement between you and the Partner.

When ordering Partner Products and Services, you agree and understand that you are doing so subject to the relevant Partner’s terms and conditions and at your own risk. Careem Technologies and its Affiliates make no representation, and give no warranty or guarantee, in respect of the Partner Products and Services. Careem Technologies and its Affiliates disclaim all liability in connection with Partner Products and Services and you agree that Careem Technologies and its Affiliates shall not be liable to you for any Loss you suffer or incur (i) as a result of any act or omission of a Partner and/or (ii) that arises out of, or in connection with, you viewing, considering, ordering, purchasing and/or receiving Partner Products and Services.

We do not guarantee that the Products and Services available through the Careem Platform at any one time will always be available. The Products and Services listed on the Careem Platform are subject to change. Careem Technologies may change, suspend or withdraw the availability of Products and Services listed on the Careem Platform without liability at any time, for any reason, with or without notice.

7. Promotions

Careem Technologies may, in its sole discretion or in conjunction with Partners or other Third Parties, make promotions available to Users on the Careem Platform. These promotions, unless made to you, shall have no bearing whatsoever on the Terms or your relationship with Careem Technologies . Promotions will in many cases be made available via Promo Codes.

Careem Technologies reserves the right to withhold or deduct credits or withdraw other features or benefits obtained through a promotion (including through the use of Promo Codes) in the event that Careem Technologies , in its sole discretion, determines or believes that the use or redemption of the promotion (or Promo Code) or receipt of the credit or benefit was in error, fraudulent, illegal, or in violation of the applicable promotion terms or the Terms.

You agree that Promo Codes: (i) must be used for the intended audience and purpose, and in a lawful manner; (ii) may not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public form or otherwise), unless expressly permitted by Careem Technologies; (iii) may be disabled by Careem Technologies without liability at any time, for any reason, with or without notice; (iv) may only be used pursuant to the specific terms that Careem Technologies establishes for such Promo Code; (v) are not valid for cash; (vi) may expire prior to your use; and (vii) Careem Technologies may establish additional terms relating to specific promotions.


8. Bundles

You may be entitled to purchase Careem Credits and Careem Bundles, or you may receive different Service Promotions, that you can apply towards payment for certain Products and Services.

Careem Credits, Careem Bundles and Service Promotions are only valid for use on the Careem Platform and are not transferable or redeemable for cash. They may also only be used for certain Products and Services, as notified to you by Careem.

Careem Credits, Careem Bundles and Service Promotions cannot be combined. If the cost of your Products and Services exceeds the applicable credit or discount value, you will be charged for the outstanding cost of the Products and Services.

Additional restrictions on Careem Credits, Careem Bundles and Service Promotions may apply as communicated to you in a relevant promotion or specific terms. Careem reserves the right to cancel, or vary the terms, relating to Careem Credits, Careem Bundles or Service Promotions without liability at any time, for any reason, with or without notice.

From time to time, Careem may offer you incentives to refer new Users to the Careem Platform. These incentives may come in the form of Careem Credits and/or Service Promotions, and Careem may set or change the incentive types, amounts, terms, restrictions, and qualification requirements for any incentives without liability at any time, for any reason, with or without notice.


9. Donations

As part of Careem Technologies support to our communities, Careem Technologies may make features available which allow you to direct Careem Technologies to support our communities in various ways. These features may be changed and updated from time to time, may not be available in all areas or markets, and those that are available at any given time may be subject to change and/or removal. Careem Technologies reserves the right to cancel, suspend or modify these features without liability at any time, for any reason, with or without notice.

To offer these features, Careem Technologies has partnered with Participating Organisations. Please note that Careem Technologies is not registered as a charitable organisation and does not hold itself out as such. Careem Technologies is not a professional or commercial fundraiser, a paid collector of fundraising appeals (or similar), or a guarantor of donations. Accordingly, the management and allocation of support to a Participating Organisation is managed by the Participating Organisation, as shown on the Careem Platform.

You can ask Careem Technologies to support the cause of a Participating Organisation by making a donation by debit or credit card or by using your Reward points earnt pursuant to the Loyalty Program or Careem Credits in your balance, where applicable. Please note that all donations made by any of the above-mentioned methods are irreversible.

Careem Technologies and its Affiliates make no representation, and give no warranty or guarantee, either expressed or implied, in respect of the donations feature (including the aforementioned methods of support). Careem Technologies and its Affiliates disclaim all liability for the donations feature and you agree that Careem Technologies and its Affiliates shall not be liable to you for any Loss you suffer arising out of, or in connection with, the donations feature.

If the Participating Organisation that you designated in your listing ceases to be a participating charity or appropriately licensed entity before Careem Technologies pays the relevant Participating Organisation, or if payment to that entity becomes impracticable, Careem Technologies may at its sole discretion choose to make payment to a Participating Organisation having a similar purpose without notifying you.

Trademarks, service marks or logos that appear in relation to the donations feature are the property of their respective owners and are likely to be registered trademarks and subject to restrictions as to their use. You must not use them without the express permission of the trade mark owner.


10. Charges and Payments

In relation to Products and Services you order through the Careem Platform, you agree to pay (where applicable): any Charges payable to Careem Technologies for Careem Technologies Products and Services; any Careem Fees payable in respect of orders for Products and Services placed through the Careem Platform (if applicable in your jurisdiction); and any Charges payable to a Partner for Partner Products and Services. All Careem Technologies Fees and Charges will be inclusive of applicable taxes where required by law, including any VAT or sales tax.

You will be notified of any applicable Charges and/or Careem Fees on the checkout page of the Careem Platform. All Charges and Careem Fees are subject to change at any time prior to your order being confirmed or delivered (where delivery of goods is involved). Charges and Careem Fees won’t change once your order has been confirmed, unless there is an obvious pricing mistake. If there is an obvious pricing mistake, you will be notified as soon as possible and will have the choice of confirming the order at the correct price or cancelling the order and receiving a full refund of any amounts already paid.

Payment for Products and Services ordered through the Careem Platform can be made by debit or credit card, or any other payment method available on the Careem Platform at the time you place your order. In certain circumstances, you understand and agree that Careem Technologies will temporarily hold an estimated amount on your credit or debit payment method while booking a Service through the Careem Platform. You understand that the amount held is an estimate of the charges that will be due by you for the Services provided by Careem Technologies and/ or Partner, but is not an actual charge for use of such Services. Any portion of such pre-authorized amount which is not applied by the Careem Technologies towards the payment of Charges will be released as soon as practicable after the Service is provided to the same payment method.

Where cash-on-delivery is available and chosen by you as the payment method, only cash payments will be accepted. You are requested to ensure that you have the exact amount in cash to cover the Charges and Careem Fees, as Captains will only carry a small amount of change. Where you chose to pay by cash-on-delivery, and you do not have the exact amount of cash to pay, the Captain may not be able to give you change. Captains cannot leave Orders with you unless full payment of all Charges is made.

At any time after you have placed an order for Partner Products and Services from a Partner, Careem Technologies: (i) may facilitate your payment of the applicable Charges on behalf of the Partner as the Partner’s limited payment collection agent; and (ii) may collect any applicable Careem Technologies Fee directly from you. Payment of the Charges in the above manner shall in all cases be considered the same as payment made directly by you to the Partner.

Charges and Careem Technologies Fees paid by you are final and non-refundable, unless otherwise determined by Careem Technologies or the relevant Partner.

All Charges and Careem Fees are due immediately and payment will be collected by Careem Technologies using the payment method selected by you at checkout, after which Careem Technologies or the Partner, as applicable, will send you a receipt by email). If your Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that Careem Technologies may, on its own behalf, and as the Partner’s limited payment collection agent, use a secondary payment method in your Account, if available.

In relation to certain Products and Services, additional Charges may become payable by you after your use of the Product and Services has ended and your payment for the Products and Services has been collected. As a result, Careem Technologies may place restrictions on your Account which prevent you from deleting a payment method for up to 120 days after your use of such Products and Services has ended. In addition, to the extent that any additional Charges become payable, Careem Technologies reserves the right to collect the additional Charges using the payment method you used to pay for the Products and Services or any other payment method added to your Account, at any time after they become due.

As between you and Careem Technologies , Careem Technologies reserves the right to establish, remove and/or revise Careem Technologies Fees at any time, for any reason, with or without notice. Charges may also be varied or revised at any time, for any reason, with or without notice, either by Careem Technologies or its Partners. Careem Technologies will use reasonable efforts to inform you of Charges and Careem Fees that may apply, provided that you will be responsible for Charges and Careem Technologies Fees incurred under your Account regardless of your awareness of such Charges or Careem Fees, as applicable, or the amounts thereof.

If you owe us or our Affiliates any money for any reason, we may set off amounts you hold with us in your Account against the amounts you owe us or our Affiliates. We will only exercise this right where we consider it is reasonable to do so and, where practicable, once we have given you notice in advance.

Refunds to which you are entitled under the Terms (or which Careem Technologies otherwise agrees to provide you) will be processed either as Careem Credits or in the same manner in which the original payment was made, at Careem Technologies’ discretion. Refunds to a credit or debit card require some time to be processed by us and the financial institution or payment service provider who has issued your debit or
credit card (as applicable). It usually takes between 7 and 15 business days for your refund to be processed and reflected in your card statement, although processing times may be longer, particularly if your card issuer is based overseas. Careem Technologies is not liable for any delay in processing refunds that is outside of its control.


11. DISCLAIMER

YOU UNDERSTAND AND AGREE THAT THE CAREEM PLATFORM (INCLUDING THE CONTENT AVAILABLE ON IT) AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. CAREEM TECHNOLOGIES AND EACH CAREEM AFFILIATE DISCLAIMS ALL REPRESENTATIONS, WARRANTIES, CONDITIONS, UNDERTAKINGS AND ANY OTHER TERMS, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, NOT EXPRESSLY SET OUT IN THE Terms, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, CAREEM TECHNOLOGIES AND ITS AFFILIATES MAKE NO REPRESENTATION, WARRANTY, CONDITION, UNDERTAKING OR GUARANTEE REGARDING THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY OR AVAILABILITY OF THE CAREEM PLATFORM (INCLUDING THE CONTENT AVAILABLE ON IT) OR ANY PRODUCTS AND SERVICES AVAILABLE THROUGH THE CAREEM PLATFORM, OR THAT THE CAREEM PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE. CAREEM TECHNOLOGIES AND ITS AFFILIATES DO NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY OR ABILITY OF THIRD PARTIES YOU ENGAGE WITH IN CONNECTION WITH PARTNER PRODUCTS AND SERVICES (INCLUDING PARTNERS THEMSELVES). YOU AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE CAREEM PLATFORM (INCLUDING THE CONTENT AVAILABLE ON IT) AND ANY PRODUCTS AND SERVICES AVAILABLE THROUGH THE USE OF THE CAREEM PLATFORM, REMAINS SOLELY WITH YOU, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.

Careem Technologies and its Affiliates are not responsible, and shall not be liable to you, for the conduct, whether online or offline, of any User, Partner or other Third Party. You are encouraged to use a reasonable degree of sensibility and caution when interacting with other Users, Partners or Third Parties.

Location data provided by the Careem Platform is for basic location purposes only and is not intended to be relied upon in situations where precise location information is needed, or where erroneous, inaccurate or incomplete location data may lead to death, personal injury, or property or environmental damage. Neither Careem Technologies , its Affiliates nor any of its providers makes any representation regarding, or warrants or guarantees, the availability, accuracy, completeness, reliability, or timeliness of location data tracked or displayed by the Careem Platform. Careem Technologies , its Affiliates and its providers shall not be liable to you for any Loss you suffer or incur as a result of inaccurate or incomplete location data displayed by the Careem Platform.


12. LIMITATION OF LIABILITY

CAREEM TECHNOLOGIES AND ITS AFFILIATES SHALL NOT BE LIABLE TO YOU FOR ANY LOSS PROFITS, LOST DATA, PERSONAL INJURY, PROPERTY DAMAGE OR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL LOSSES RELATED TO, SUFFERED OR INCURRED IN CONNECTION WITH, OR OTHERWISE RESULTING FROM, ANY USE OF THE CAREEM PLATFORM OR PRODUCTS AND SERVICES AVAILABLE THROUGH THE CAREEM PLATFORM, EVEN IF CAREEM TECHNOLOGIES AND/OR ITS AFFILIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES. CAREEM TECHNOLOGIES AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY LOSSES ARISING OUT OF: (i) YOUR USE OF OR RELIANCE ON THE CAREEM PLATFORM (INCLUDING THE CONTENT AVAILABLE ON IT) OR THE PRODUCTS AND SERVICES AVAILABLE THROUGH THE CAREEM PLATFORM, OR YOUR INABILITY TO ACCESS OR USE THE CAREEM PLATFORM OR THE PRODUCTS AND SERVICES AVAILABLE THROUGH THE CAREEM PLATFORM; OR (ii) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY THIRD PARTY (INCLUDING PARTNERS), EVEN IF CAREEM TECHNOLOGIES AND/OR ITS AFFILIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES. CAREEM TECHNOLOGIES AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND OUR REASONABLE CONTROL.

IN NO EVENT SHALL CAREEM TECHNOLOGIES AND ITS AFFILIATES’ TOTAL LIABILITY TO YOU (WHEN TAKEN TOGETHER IN THE AGGREGATE) ARISING OUT OF OR IN CONNECTION WITH THE Terms (INCLUDING YOUR RECEIPT AND USE OF THE CAREEM PLATFORM, THE PRODUCTS AND SERVICES, ANY WEBSITE OR APPLICATION LINKED THERETO, ANY MATERIAL POSTED ON THE FOREGOING OR ACTS OR OMISSIONS OF PARTNERS OR OTHER THIRD PARTIES) FOR ALL LOSSES AND CAUSES OF ACTION EXCEED TWO THOUSAND UNITED STATES DOLLARS OR AN EQUIVALENT AMOUNT IN ANOTHER CURRENCY.

THE CAREEM PLATFORM MAY BE USED BY YOU TO REQUEST AND SCHEDULE PARTNER PRODUCTS AND SERVICES WITH PARTNERS, BUT YOU AGREE THAT CAREEM HAS NO RESPONSIBILITY OR LIABILITY TO YOU ARISING OUT OF OR IN CONNECTION WITH ANY PARTNER PRODUCTS AND SERVICES.

THE LIMITATIONS OF LIABILITY IN THIS SECTION AND THE DISCLAIMER IN THE SECTION ABOVE DO NOT PURPORT TO LIMIT LIABILITY OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE LIMITED OR ALTERED UNDER APPLICABLE LAW.


13. Indemnity

You agree to defend, indemnify and hold Careem Technologies , its Affiliates, officers, agents, directors and/or other employees and harmless from any and all Losses they suffer or incur arising out of, or in connection with: (i) your receipt and use of the Careem Platform and the Products and Services ordered through your use of the Careem Platform; (ii) your breach or violation of the Terms; and/or (iii) your violation of the rights of any Third Party.


14. Insurance

We are not required to procure insurance for, nor are we responsible for, your private belongings, such as the damage or loss of private belongings, including, but not limited to, damage or loss caused by: (i) theft or snatching; (ii) Careem Technologies Products and Services which you have ordered through the Careem Platform(iii) Partners (or their authorised personnel) when providing Partner Products and Services which you have ordered through the Careem Platform. You are advised not to keep your personal belongings unattended, including when you request a Partner to provide Partner Products and Services in your household or other premises.

By using the Careem Platform, you agree to accept such risks and agree that Careem Technologies is not responsible, and shall not be liable to you, for the acts or omissions of Users, Partners or any other Third Party.

You acknowledge that Careem Technologies may have its own insurance coverage from which you may benefit. In the event thereof, you agree to provide proper notification of an insurance claim and accept the benefit of any insurance service provided at your own risk and you hereby acknowledge that Careem Technologies is not acting as a broker in connection therewith, nor does it provide any guarantees, warranties or any other assurances in connection therewith.


15. Data Protection

Our collection and use of personal information in connection with the Careem Platform and the Products and Services is as provided in our Privacy Policy that is located here.


16. Communications

By becoming a User, you agree to receive communications from us, including via e-mail, text message, calls, and push notifications. You agree that texts, calls or pre-recorded messages may be generated by automatic telephone dialling systems (where allowed by and in compliance with local law).

Communications from Careem Technologies and/or its Partners may include, but are not limited to: operational communications concerning your User Account or use of the Careem Platform or Products and Services, updates concerning new and existing features on the Careem Platform, communications concerning promotions run by us or our partners, and news concerning Careem Technologies and industry developments.

Standard text messaging charges applied by your cell phone carrier will apply to text messages we send. If you no longer wish to receive promotional or marketing-related communications, please contact legal@careem.com and/or review Careem Technologies Privacy Policy for further information.


17. General Rules on Competitions, Contests and Giveaways

Unless otherwise specified, Careem Technologies will, solely or with Partners or Third Parties, conduct all Competitions as described in this section. By entering or participating in a Competition, each Entrant agrees to these rules, as well as any separate additional specific terms that may apply to the Competition. When entering or participating in a Competition, an Entrant may be eligible for a Prize. Careem Technologies may reject an entry at its own discretion, provided that such rejection will not conflict with applicable law.

The Prize is non-transferable, non-exchangeable and no cash alternative is offered. In the event of a Prize being unavailable, Careem Technologies reserves the right to offer an alternative prize of equal or greater value if circumstances beyond Careem Technologies control makes it necessary to do so. To the extent permitted by law, the Competition Winner will be responsible for any and all taxes incurred in relation to receipt of the Prize.

Participation in a Competition does not automatically mean that the Entrant will win a Prize. Competition Winners will be selected in line with the terms and conditions of the Competition. Reasonable efforts will be made to contact the Competition Winner, but if the Competition Winner cannot be contacted or fails to reply to Careem Technologies communication within the communicated timeframe, Careem Technologies reserves the right to offer the prize to the next eligible Entrant. Careem Technologies will not be liable if the Prize does not reach the Competition Winner for reasons beyond the reasonable control of Careem Technologies.

Neither Careem Technologies , its Affiliates nor any Partners involved in a Competition accepts responsibility for any errors, omissions, interruptions, deletion, or unauthorized access to Competition entries, or entries lost or delayed whether or not arising as a result of server functions, virus, bugs, or other causes outside Careem Technologies ,
its Affiliates’ and/or a Partner’s control. Neither Careem Technologies , its Affiliates nor Careem Technologies Partners shall be liable for any Loss suffered or incurred by you arising out of, or in connection with, the same. WITHOUT PREJUDICE TO THE FOREGOING, IN NO EVENT SHALL CAREEM’S, ITS AFFILIATES’ AND/OR A PARTNER’S TOTAL LIABILITY TO ANY ENTRANT FOR ALL LOSSES AND CAUSES OF ACTION IN CONNECTION WITH ANY COMPETITION OR ANY MATERIAL PUBLISHED IN RELATION TO A COMPETITION EXCEED FIVE UNITED STATES DOLLARS.

Careem Technologies reserves the right to cancel or amend the Competition and any associated terms and conditions without liability at any time, for any reason, with or without notice. Any changes will be notified to the Entrants as soon as reasonably practicable. If these terms do not, or do not clearly, cater for a solution to any matter which may arise, then Careem Technologies shall have the sole discretion to decide finally on any such matter. Careem Technologies decisions on any aspect of the Competition is final and binding and no correspondence will be entered into about it.

18. Dispute Resolution

a) Arbitration

You agree that all Disputes between you and Careem Technologies in relation to the Careem Platform and/or Careem Technologies Products and Services will be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened
infringement, misappropriation or violation of that party’s copyrights, trademarks, trade secrets, patents or other proprietary rights.

You acknowledge and agree that you and Careem Technologies are each waiving the right to a trial by jury or to participate as a plaintiff or class in any purported class action or representative proceeding. Further, unless both you and Careem Technologies agree in writing, the arbitrator may not consolidate more than one person’s claim and may not otherwise preside over any form of any class or representative proceeding. If this specific paragraph is held unenforceable, then the entirety of this ‘Dispute Resolution’ section will be deemed void. Except as provided in the preceding sentence, this ‘Dispute Resolution’ section will survive any termination of the Terms. This ‘Dispute Resolution’ section applies to all Disputes between you and Careem Technologies .

b) Arbitration Process and Rules

All Disputes shall be first mandatorily submitted to mediation proceedings under the International Chamber of Commerce Mediation Rules (“ICC Mediation Rules”). If such Dispute has not been settled within sixty (60) days after a request for mediation has been submitted under such ICC Mediation Rules, such Dispute can be referred to and shall be exclusively and finally resolved by arbitration under the Rules of Arbitration of the International Chamber of Commerce (“ICC Arbitration Rules”). The ICC Arbitration Rules’ Emergency Arbitrator provisions are excluded. The Dispute shall be resolved by one (1) arbitrator to be appointed in accordance with the ICC Arbitration Rules. The place of both mediation and arbitration shall be in the city in which Careem Technologies has its registered office. The language of the mediation and/or arbitration shall be English, unless you do not speak English, in which case the mediation and/or arbitration shall be conducted in both English and your native language. The existence and content of the mediation and arbitration proceedings, including documents and briefs submitted by the parties, correspondence from and to the International Chamber of Commerce, correspondence from the mediator, and correspondence, orders and awards issued by the sole arbitrator, shall remain strictly confidential and shall not be disclosed to any Third Party without the express written consent from the other party, unless: (i) the disclosure to the Third Party is reasonably required in the context of conducting the mediation or arbitration proceedings; and (ii) the Third Party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.

19. Other General Provisions

a) Rights of Third Parties

Subject to the remainder of this section, the Terms does not give rise to any rights for a Third Party to enforce any term of the Terms.

Apple Inc. and Google, Inc., and/or each of their applicable international subsidiaries and affiliates will be third-party beneficiaries to the Terms if you access the Careem Platform using applications developed for Apple iOS or Android-powered mobile devices, respectively. These third-party beneficiaries are not parties to the Terms and are not responsible for the provision or support of the Careem Platform in any manner. Your access to the Careem Platform using these services or applications is subject to terms set forth in the applicable third-party beneficiary’s terms of service. You agree that you will comply with such terms of service at all times.

You agree that you are entering into the Terms for the benefit of Careem and each of Careem’s Affiliates. This means that Careem and each of Careem’s Affiliates is:

(i) entitled to the benefit of the rights granted to us in the Terms; and

(ii) a beneficiary of the obligations you commit to in the Terms.

You acknowledge that, for these purposes, Careem and each Careem Affiliate shall be entitled to enforce the Terms against you as if references in the Terms to ‘Careem’, ‘we’, ‘us’ and ‘our’ (and any similar terms) included a reference to Careem and each Careem Affiliate.

b) Waiver

A waiver of any right or remedy to which we may be entitled is only effective if we give the waiver in writing. A delay in exercising or failure to exercise, or the single or partial exercise of, any right or remedy to which we are entitled shall not waive that or any other right or remedy, nor shall it prevent or restrict us further exercising of that or any other right or remedy.

c) Claims of Copyright Infringement

Please email legal@careem.com if you think that any Content on the Careem Platform infringes your copyright in any way. In the email, please indicate the exact URL where the Content is hosted and provide any other information that is in your possession that will enable us to assess and deal with your claim promptly.

d) Notice

We may give notice by means of a general notice on the Careem Platform, electronic mail to your email address in your Account, or by written communication sent to your address as set forth in your Account.

You may give notice to us by written communication to Careem’s email address at legal@careem.com.

e) Assignment and Transfer

You may not assign, transfer or otherwise deal in any manner with your rights and obligations under the Terms (in whole or in part), without our prior written approval.

You give your approval to Careem Technologies assigning or transferring its rights and obligations under the Terms (in whole or in part) to any Third Party, including to: (i) an Affiliate; (ii) an acquirer of Careem Technologies equity, business or assets; or (iii) a successor by merger.

f) Relationship

No joint venture, partnership, employment or agency relationship exists between you and Careem as a result of the Terms or your use of the Careem Platform.

g) Severability

If any provision of the Terms is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of the Terms but the legality, validity and enforceability of the other
provisions in the Terms shall not be affected.

In that event, the parties shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of the Terms.

h) Entire Agreement

These Terms, together with any supplemental terms disclosed to you from time to time, constitutes the entire agreement and understanding of the parties with respect to its subject matter and replaces and supersedes all prior or contemporaneous agreements or undertakings regarding such subject matter. You acknowledge that in entering into the Terms you do not rely on any statement, representation, assurance or warranty that is
not set out in the Terms.

i) Choice of Law

The Terms are governed by, and shall be construed in accordance with, the laws of the jurisdiction in which the relevant Careem Technologies Affiliate is incorporated, without giving effect to any conflict of law principles, except as may be otherwise provided in supplemental terms applicable to your region.

PART 2 – PRODUCT AND SERVICE SPECIFIC TERMS


20. Food

a) General

You can order food from Partnered Restaurants (“Restaurant Partners”) through the Careem Platform. Careem Technologies acts as a facilitator between you and the Restaurant Partners. “Food” is a Partner Product and Service and offers a wide variety of foods from a variety of Restaurant Partner, and the ordering process is simple and secure.

The Careem Platform enables you to have your favourite meals delivered to your door with just a few clicks. You can also place group orders by simply sharing a special link with your colleagues, friends and family to add their preferences. By doing so, everyone can order their favourite meal together with only one delivery fee.

b) Responsibility for Meals

Restaurant Partners remain solely responsible for the accuracy, quality, ingredients and condition of meals you receive. Each meal you order is a Partner Product and Service for the purposes of these Terms.

It is important that you understand that Careem Technologies does not verify the ingredients or quality of meals you order through the Careem Platform, nor the accuracy of meals against the description on the Careem Platform. Careem Technologies endeavours to display accurate information on the Careem Platform to help you make decisions about what meal to order; however, all of the information displayed is provided to us by our Partners or by a reputable third party.

Careem Technologies and its Affiliates make no representation, and give no warranty or guarantee, in respect of meals you order through the Careem Platform. Careem Technologies and its Affiliates disclaim all liability in connection with meals you order through the Careem Platform and you agree that Careem Technologies and its Affiliates shall not be liable to you for any Loss you suffer or incur in connection with the same.

Whilst Careem Technologies and its Affiliates are not responsible for the meals you order through the Careem Platform, Careem Technologies is committed to doing all it reasonably can to ensure your experience with Careem Technologies is a pleasant one. In pursuit of this, Careem Technologies may facilitate complaints made by you in relation to meal you order through the Careem Platform by acting as an intermediary between you and the Partner from whom you ordered your meal.

21. Quik & Supermarkets

a) General

The Careem Platform allows you to order groceries from “Quik” a Careem Technologies Product and Service or Partner Supermarkets. The Careem Platform acts as a facilitator between you and the Partner Supermarkets.

The Careem Platform offers a wide variety of groceries from a variety of Partner Supermarkets and Quik itself, and the ordering process is simple and secure.

b) Responsibility for Groceries

Whilst Careem Technologies may provide delivery services in relation to groceries you order from some Partner Supermarkets, all such groceries are provided to you by a Partner unless they are provided by Quik in which case Careem Technologies or its relevant Affiliate is responsible. The Partner is solely responsible for the accuracy, quality, ingredients and condition of groceries you receive where they are ordered through the Partner Supermarkets - Careem Technologies or its relevant Affiliate
will be responsible where Quik is providing this Service. The groceries you order from Supermarkets are a Partner Product and Service for the purposes of these Terms. The groceries you order from Quik are a Careem Product and Service for the purpose of these Terms.

It is important that you understand that Careem Technologies does not verify the ingredients or quality of groceries you order through Partner Supermarkets nor the accuracy of those groceries against the description on the Careem Platform. Careem Technologies endeavours to display accurate information on the Careem Platform to help you make decisions about what groceries to order; however, all of the information displayed is provided to Careem Technologies by its Partners or Affiliates.

In the event any grocery item in your order is out of stock, you will receive a notification from us to replace the grocery item. If the replacement is not confirmed, the store will process the order with the remaining groceries. You can also choose to cancel the order if you don’t wish to continue with the replaced grocery items.

Careem Technologies and its Affiliates makes no representation, and gives no warranty or guarantee, in respect of groceries you order through the Partner Supermarkets product/service. Careem Technologies and its Affiliates disclaims all liability in connection with groceries you order through the Partner Supermarkets product/service and you agree that Careem Technologies and its Affiliates shall not be liable to you for any Loss you suffer or incur in connection with the same.

Whilst Careem Technologies is not responsible for the groceries you order through the Supermarkets product/service, Careem Technologies is committed to doing all it reasonably can to ensure your experience is a pleasant one. In pursuit of this, we may facilitate complaints made by you in relation to groceries you order through the Supermarkets product/service by acting as an intermediary between you and the Partner from whom you ordered your groceries.

22. Pick up and Buying Services (Delivery)

You can also access a hassle-free one stop solution for your daily delivery needs through the Careem Platform. Please note that this is a Careem Technologies Product and Service. You can use the Delivery service, if you need something picked up and delivered to you or want to send something to someone or even something purchased from a store!

To use this Product and Service, simply open the Careem Technologies Everything App and select the Delivery option. Once you have placed your order, a Careem Captain will be dispatched to pick up your item or purchase it for you. Your item will then be delivered to you in a timely manner.

In Dubai, we offer two delivery services: Send and Buy. The Send service allows you to send something to someone else or get something picked up and delivered to you. You can use Send to deliver a variety of items, including documents, packages, food, and even flowers.

The Buy service allows you to have something purchased and delivered to you. This is a great option if you don’t have time to go shopping or if you want to surprise someone with a gift. Please note that the maximum value of items that can be purchased through the Buy service is AED 350.

Please note that our Captains can’t purchase any vouchers (i.e. DU or Etisalat) or anything that is considered illegal on your behalf. This service can not be used to send cash or other valuable items such as cards, jewellery or electronics.

Don’t forget that (in some jurisdictions) you can use Careem Pay for bill payments and mobile recharge, without any additional charges as well as transferring money.

In certain jurisdictions, you may only be able to use the Send delivery service. Each jurisdiction has its own maximum limit as to the value of items that can be sent. Please visit the Careem Platform for more information. Always remember that, wherever you are transporting items using this service, you do so at your own risk.

23. Delivery of Food, Groceries and Goods - Careem Delivery and Self Delivery

a) General

The Careem platform supports two delivery options: Careem delivery and
Self-delivery. The type of delivery applicable in your orders will
depend on the Partner and the availability of options in your area.

i) Careem Delivery:

Certain meals, groceries, goods and/or products available on the Careem Platform may be delivered to you by subcontractors of Careem Technologies. This is what we refer to as “Careem Delivery”. In the case of Careem delivery you will contract with and be charged by Careem. Careem will request that an independent contractor collect items from the Partner and deliver those items to you on Careem’s behalf. In the case of Careem delivery, Careem will endeaovour to ensure that your delivery will get to you as soon as reasonably possible but, unfortunately, there are a number of factors that may cause delays. We will always give you an estimated range for delivery when you place your order. When your order is being delivered by Careem Technologies, you will receive a notification on the Careem Platform at the the time you place your order. You will also have the option to track your order on the Careem Platform.

Please note that the subcontractors involved in the delivery service provided by Careem Technologies are independent contractors and not our employees. While we ensure a rigorous selection process for partnering with subcontractors, we do not have direct control over their operations, schedules or personnel.

ii) Self-delivery :

Certain meals, groceries and/or goods/products available on the Careem Platform may be delivered to you by the Partner from whom you order the products and services rather than Careem Technologies (subcontractors). This is what we refer to as “self-delivery”.

Where a meal, grocery or goods/products available on the Careem Platform are made available as a self-delivery, you will be notified of this on the Careem Platform at the time you place your order. In these circumstances, by placing an order for the meal or good/product through the Careem Platform, you are placing an order for the supply and delivery directly with the Partner. The contract for supply and delivery, and your receipt, of the meal or goods/products is directly between you and the Partner. Unfortunately, there is no option to track your order with Self Delivery. If you have a problem with the order please contact the restaurant directly.

b) Delivery Fee

The price of delivery will be determined based on the price shown on the Careem Platform when you place your order. All fees are stated in the applicable local currency and will state whether taxes are included or not.

c) Delivery Location

Your Order will be delivered to the delivery address selected by you at the time of checkout. Unless otherwise agreed with Careem Technologies in writing, you will not be able to change the delivery address after your order has been accepted by Careem Technologies . It is therefore important that you check each order to ensure that you have selected the correct delivery address before you proceed to place it.

If you are not at the delivery location we may, if you have paid by card, leave your meal at the delivery address. You may also want to ask us to (for example, by including a request in the order instructions) leave your meal, groceries, products or goods picked up or bought by the Captain, in a ‘safe place’. A ‘safe place’ is anywhere that you ask us
to leave your meal, groceries, products or goods picked up or bought by the Captain or any place that we reasonably determine to be a safe place for us to leave your order. Please note that, where you choose cash-on-delivery as the payment method for an order, we will not be able to leave your order in a safe place.

You acknowledge that all Orders left in a safe place are left in the safe place at your own risk. Careem Technologies and its Affiliates disclaim all liability in respect of leaving your order(s) in a safe place and you agree that Careem Technologies and its Affiliates shall not be liable to you for any Loss you suffer arising out of, or in connection with, Careem or Partner leaving your order in a safe place.

d) Delivery Time

After you place your Order, we will endeavour to deliver (or facilitate the delivery of) your Order as quickly (and safely) as we can. You should therefore be present in the delivery location and available to accept your Order at the time you place the order.

To enable you to prepare for receiving your Order, we will provide you with an estimated delivery window in your order confirmation and provide live updates to the estimated delivery window on the Careem Platform (unless your order is a self-delivery, in which case we will not be able to provide live updates).

Whilst we will do our best to deliver your meal within the delivery window we provide to you, there are a number of factors outside of our control that affect the speed at which deliveries are made. For example, we are reliant on our Partner having the meal, grocery, products or goods items available for us to collect promptly and the traffic and
weather conditions. The speed that we are able to deliver your order is also affected by other factors, such as the order quantity, the distance between our Partner’s premises or the location you have selected for pick up/buying of goods/products and your delivery location and the time of day you place your order.

You acknowledge that the delivery window we provide is an estimate only. It is not a binding commitment from us. Careem Technologies and its Affiliates disclaim all liability for any delay in the delivery of your order and you agree that Careem and its Affiliates shall not be liable to you for any Loss you suffer arising out of, or in connection with, a
delay in your order being delivered to you.

e) Failed Delivery

Whilst, where practicable, we or the Partner (in case of self delivery), will attempt to contact you if there is no one to accept delivery at the delivery location we reserve the right to cancel your order without liability where we attempt to deliver your order l but are unable to do so because of any act or omission by you. This includes where no one is
present at the delivery location to receive the order or are unable to gain access to the delivery location you have selected, where there is no ‘safe place’ to leave the order , or any other reason outside of our control.

Where we cancel your order, you will be notified of the same and, unless we agree otherwise at the time, you will not be entitled to a refund of any of the Charges/Careem Fees you have paid in connection with the order (whether the charges/fees for the meal itself or the delivery services).

As an alternative to cancelling the order, we may choose to leave your order in a safe place at, or near, the delivery location, if we consider it appropriate to do so, and provided you did not choose cash-on-delivery as the payment method.

f) Special Instructions

Where you provide special instructions in relation to the delivery of your order we will pass on those instructions to the Partner in the case of ‘Self Delivery’ or endeavour to comply with your instructions. However, in some cases, complying with your instructions may not be feasible, possible or responsible.

Where complying with your instructions is not, in our reasonable opinion, feasible, possible or responsible, we will proceed with the delivery in accordance with our standard delivery procedure.

g) Tips

At the time you place an order for selected Products and Services through the Careem Platform you will have the option to pay a tip to your Captain. Any tip you make will be collected by Careem using the payment method used to pay for your order. The Captain will receive 100% of any tip you choose to make.

Where you choose the cash-on-delivery payment method, you can tip the Captain directly at the time of delivery.

You can obtain detailed information about the Food, Quik and Supermarkets product/service by visiting the ‘Help’ section of the Careem Platform (available here).

The Help section of the Careem Platform contains further information on things like: the timings and area of delivery and how you can contact Careem or its Partner for your order and details of the Captain responsible for delivering your order.

Whilst we hope this will never be the case, the Help section also contains details on how you can make a complaint about the order you receive and/or your Captain, in the event you have a disappointing experience.

24. Careem Bike

Careem Bike is a Careem Product and Service. You can obtain detailed information about the Careem Bike product/service by visiting the ‘Help’ section of the Careem Platform (available here).

The Help section of the Careem Platform contains detailed information on the Bike product/service. It includes information on things like: what the Bike product/service is; how you can use the bikes; the measures you should take to ensure your use of bikes is safe; and what happens if you have any technical issues with bikes. It also includes contact details for Careem, should you need to contact us for any reason related to
Careem Bike.

The terms available via the following link are hereby incorporated into the Terms and, together with these Terms and any other supplemental terms provided to you from time to time, shall govern your receipt and use of the Careem Bike product/service: Rules and regulations – Careem.

In relation to your use of bikes as part of the Careem Bike product/service, you must:

  • perform a safety-check on bikes prior to using them, (available here) for guidance;

  • ensure the bikes are only used for the purpose for which they are designed and in accordance with any instructions issued by Careem;

  • never ride a bike without wearing a helmet;

  • at all times, keep the bikes in your possession and control;

  • take such steps (including by complying with all safety and usage instructions provided by Careem) as may be necessary to ensure that the bikes are at all times safe used and without risk to health when it is being used;

  • ensure that the bikes are kept in as good an operating condition as they were when you received them; and

  • return the bikes within a maximum of 24 hours from the time you take possession of them. Careem reserves the right to levy a penalty of up to USD 1000 or any equivalent currency in your country for any bikes not returned to Careem within 24 hours for any reason.

The bikes at all times remain the property of Careem. You have no right, title or interest in the bikes, other than the right to use them in accordance with the Terms.

You must provide Careem with immediate notice in the event of any loss, accident or damage to a bike. The risk of loss, theft, damage or destruction of each bike shall pass to you once you take possession of the bike. From that time until such time as you return the bike to Careem, you shall be responsible for any loss, theft, damage or destruction. You shall pay to Careem any Losses incurred by Careem as a result of any loss, theft, damage or destruction of the bike, on demand, whilst the bike was hired by you.

Bikes can be reserved by you for minors provided they are over 15 years of age and are permitted to use the bike in the intended way under applicable laws in your jurisdiction. You are responsible for ensuring that the minor wears a helmet at all times and their use otherwise complies with the Terms. You are also responsible for performing safety-checks on the bike prior to their use. You must educate the minor on the laws that apply to them in their use of the bike and the requirements of the Terms, and you must supervise their use at all times. You are solely and exclusively responsible for the activity of minors that you make a reservation for and their use of the bikes.

With respect to the Careem Bike product/service, the applicable Charges will be charged according to your membership plan and, once payment has been made, you will be able to independently collect the bikes from their respective stand and/or parking location for use.

In addition to any applicable Charges being charged according to your membership plan, applicable excess will result in overtime Charges. All overtime Charges, as mentioned in the Careem Platform, will be charged your Account.

25. Careem Pay

Careem Pay is a Careem Product and Service. As part of your User Account, Careem may provide you with access to Careem Pay. Careem Pay allows you to: (i) manage payment for Products and Services; (ii) add and store Careem Credits; (iii) receive Careem Credits from other Users; and/or (iv) make payments to Off-App Merchants for goods, services or products you purchase from Third Party websites not present on, of affiliated with, the Careem Platform.

Please note that not all features of Careem Pay are available in every market. The features of Careem Pay are also subject to change by Careem without liability at any time, for any reason, with or without notice.

In addition, Careem may, at its discretion at any time, offer additional payment features, or restrict access to one of more of the features available, to Users that have successfully verified their identity, as required by anti-money laundering, counter-terrorism financing laws and other “know your customer” laws and regulations (“Enhanced Wallet Services”). The availability and use of such Enhanced Wallet Services is also subject to your acceptance of the related terms and conditions, which supplement the Terms. In the case of any inconsistency between these Terms and the Enhanced Wallet Services terms and conditions, the Enhanced Wallet Services terms and conditions will prevail.

The use of certain Careem Pay features may be subject to: Careem Fees (as advertised on the Careem Platform); and limits in respect of the number or value of transactions you are entitled to do. Careem Fees and limits may be modified by Careem from time to time.

a) Paying with a User Account

Careem will credit Careem Credits to your User Account following your instruction to so and collection or receipt of funds from you. Careem Credits may be reloaded with additional value by you (subject to any limits imposed by Careem or by law and as may be notified to you from time to time), as described below.

You can use your Careem Credits to pay for Products and Services, in which case Careem (or a regulated financial institution or payment system provider on behalf of Careem) will satisfy and settle the payment obligation up to the Careem Credit balance reflected in your User Account. Unless you are a User of Enhanced Wallet Services, Careem Credit is not redeemable for cash.

As part of your User Account, you may load Careem Credits by any one or more of the following payment methods (where offered by Careem from time to time):

  • by cash paid to authorised Third Parties (where enabled by Careem
    and permitted by law);

  • debit card;

  • credit card;

  • gift card (where available and permitted by law);

  • any other payment method made available by Careem from time to time,


(each a “Payment Method”).

You can reload Careem Credits at any time before the start of and Order for Products and Services (e.g., ordering a meal or groceries) by clicking on the Careem Pay button and selecting the ‘Add Funds’ option under ‘Your Wallet’. If you want to add a new Payment Method, you must do so before using Products and Services.

By selecting a particular Payment Method, you acknowledge that you are agreeing to the terms of service of Careem’s payment processing partners and the financial institution or payment service provider who has issued your selected Payment Method. You further agree that you will bear the cost of any fees imposed by such payment processing partners or financial institutions in connection with your selected Payment Method.

Careem may, in its sole and absolute discretion, choose to refuse a request to reload Careem Credit, including (without limitation) where reloading would result in the aggregate value stored in your User Account exceeding any value permitted by prevailing laws and regulations.

Careem, in its sole and absolute discretion, may, at any time (including at the time of completing a transaction), notify you via the Careem Platform that it has imposed a maximum amount by which you may reload or inform you that you have reached the limit on the number of times you may reload credits within a specified period.

You may load and hold Careem Credit only in the currency of the country to which your User Account is linked based on the mobile number associated with your User Account (“Base Currency”), and the Base Currency cannot be changed at a later date. If you top-up your User Account or pay for Products and Services using a card denominated in a currency other than the Base Currency or the currency in which the relevant Products and Services are charged (as the case may be), you may be subject to additional foreign exchange fees and rates, for which Careem accepts no liability and is unable to give you forewarning. If you wish to use Careem Credit to make payments in another currency, including payments using a combination of the balance in your User Account and a card, Careem will convert the foreign currency amount due by you into your Base Currency using a conventional exchange rate set by Careem from time to time. Such exchange rate may be different from the official exchange rate in effect at the relevant time, and you will be deemed to have accepted it by confirming the payment transaction.

By loading Careem Credit you acknowledge and agree that you are not depositing money with Careem. Careem may hold any funds received from you with such other facilities or third parties as Careem considers appropriate, either separately or together with other property, and use any such funds as it sees fit for its own purposes without retaining possession and/or control of a like amount of money or other assets for your benefit. Your rights in relation to any such funds are limited to a contractual obligation for Careem to provide an equivalent amount in Careem Credit for your use in connection with Products and Services.

b) Bills and Recharge

The ability to access bill payment and mobile top-up services (“Bills and Recharge Services”) is made available to you through the Careem Platform and is subject to change and availability. Careem reserves the right to suspend, withdraw or restrict the availability of the Bills and Recharge Services without liability at any time, for any reason, with or without notice.

In respect of the Bills and Recharge Services, Careem is providing the right for you to pay a utility bill or buy airtime as agent for the relevant utility company or mobile operator.

You will be required to input the mobile number or bill details to which any payment is to be credited into the appropriate place(s) on the Careem Platform. You are responsible for ensuring that such details have been correctly entered. If applicable, you will also be required to select the top up amount to be credited to the desired mobile number.

You agree that you will be responsible for resolving any disputes relating to payments related to Bills and Recharge Services initiated through the Careem Platform with the relevant utility company or mobile operator. Careem and its Affiliates disclaim all liability to you in connection with any such payment, and you agree that Careem and its Affiliates shall not be liable to you for any Loss you suffer or incur in connection with the same.

The fees for Bills and Recharge Services may change depending on applicable biller or mobile operator and will be shown on the Careem Platform. All bills and recharge transactions are final and cannot be modified or removed once you have entered and confirmed the relevant information on the Careem Platform.

c) 1-Click Checkout

Through your use of Third Party websites and applications, you may have access to the 1-Click Checkout product/service. 1-Click Checkout makes it easier for Off-App Merchants to collect payments for goods, services or products that they provide to you. 1-Click Checkout enables you to use your existing card-on-file to complete your purchase on the Off-App Merchant site or app.

Using 1-Click Checkout does not change anything about the relationship you have with that Off-App Merchant or your card provider or bank in terms of your payment for the goods, services or products of the Off-App Merchants.

If you elect to use the 1-Click Checkout where an Off-App Merchant has this feature enabled, you will be redirected to your existing Payment Methods on the Careem Platform. Your available Payment Methods will be limited to your cards-on-file only and you will not be able to use Careem Credits in relation to this feature. In order to enable the processing of your payment for goods, services or products offered by the Off-App Merchant, Careem is using the information you store through the Careem Platform (or with permitted third party providers (where relevant)) to make payments for Products and Services.

You are responsible for the purchase you make using 1-Click Checkout and the Off-App Merchant is responsible for supplying you with the goods, services or products you have purchase through their site or app. If there is an issue with the goods, services or products you have purchased using 1-Click Checkout, please get in touch, directly, with the Off-App Merchant. Any returns, exchanges, refunds are subject to the policy of the Off-App Merchant you have purchased from. Careem is not responsible for processing or managing refunds, chargebacks or other issues relating to your purchase. Careem is not subject to and does not have control over the policies of any Off-App Merchant and is not responsible for the actions or omissions of any Off-App Merchant. Careem and its Affiliates disclaim all liability in connection with goods, services or products you purchase from Off-App Merchants and you agree that Careem and its Affiliates shall not be liable to you for any Loss you suffer or incur (i) as a result of any act or omission of an Off-App Merchant and/or (ii) that arises out of, or in connection with, you viewing, considering, ordering, purchasing and/or receiving goods, services or products from Off-App Merchants.

d) Fraudulent Activity

You agree to notify Careem immediately upon becoming aware of any fraudulent activity perpetrated through your User Account. Notifications may be made via the Careem Platform or by email legal@careem.com You are solely responsible for informing your financial institution or payment services provider of any fraud related to a payment card saved in your User Account.

You agree that we and our Affiliates are not responsible for the unauthorized use of your User Account. Careem reserves the right (in its sole and absolute discretion) to suspend or void any transaction, where we suspect that the transaction is related to fraudulent, unlawful, illegal, suspicious or criminal activity or that you are otherwise in violation of the Terms.

If Careem becomes aware or has reason to believe that your User Account is being used in an unauthorized, unlawful, improper or fraudulent manner or for criminal activities (or has been so used previously), or you do not comply with applicable laws and regulations or any of the conditions relating to the use of the Products and Services, including the Terms, Careem may at its sole discretion take certain actions against you, including, but not limited to: (i) suspending or terminating your right to use the User Account, certain products, the Careem Platform (or certain parts of it), (ii) blocking or clawing back any available balance in your User Account; (iii) legal action against you (including claim for the cost of the action), and/or (iv) disclosure of such information to law enforcement authorities as we feel is necessary.

e) Chargebacks, refunds and disputes

When you use a card for payment through your User Account, the issuer of that card is responsible for the settlement of the transaction. You acknowledge that transaction errors may result in a reversal of the transaction, fees, claims, penalty or chargeback from the financial institution or payment services provider that has issued the payment card. You acknowledge that the financial institution or payment services provider determines any amount reversed, returned or charged back. Careem is bound to follow the instructions of that financial institution or payments services provider. Careem and its Affiliates disclaim all liability in connection with the reversal of a transaction, fees, claims, penalty or chargeback by the financial institution or payment services provider and you agree that Careem and its Affiliates shall not be liable to you for any Loss you suffer or incur in connection with the same. You agree that you will be responsible for resolving any disputes with the financial institution which has issued your card.

If, notwithstanding the above, you have a complaint in relation to Careem Pay or any transactions you have made using your User Account, please contact us at legal@careem.com . Any dispute must be submitted within 90 days of the transaction in dispute. We may ask for information about the disputed transaction, but please note that we will never ask you for any security information about your User Account.

Careem reserves the right to investigate the circumstances of each complaint it receives and to determine the most appropriate course of action, including: (i) declining your application for any or all of the Products and Services, (ii) terminating any or all of the Products and Services, (iii) reversing any relevant transaction, (iv) withholding funds from you or restricting your access to your User Account, or (v) doing anything else we reasonably consider necessary. We will inform you of any such actions we take unless we have reasonable belief that we are prevented from doing so by law or regulation or we believe that doing so would compromise our anti-fraud or security measures.

You acknowledge that Careem is under no obligation to recall funds and will not be liable if it is unable to partially or fully recall the funds subject to the dispute. You may not be eligible to receive a refund if you failed to keep the security details relating to your card safe or are a victim of financial fraud, even if the transaction was done by third parties without your knowledge or permission.

26. Loyalty Program

Loyalty Program is a Careem Product and Service. In markets where the Loyalty Program is available, you automatically become part of the Loyalty Program by creating an Account. The Loyalty Program is not available in markets where CareemPlus is available.

The Loyalty Program is a way for Users to earn points for using the Careem Platform. Points can be redeemed for rewards, such as discounts on different Products and Services on the Careem Platform. The number of points you earn depends on your usage of the Careem Platform. You can also earn points by referring friends to Careem.

Points expire after 12 months, so be sure to redeem them before they expire. Rewards and participating partners may vary from market to market, so check the Careem website or app for the latest information. Careem has the right to change the terms of the Loyalty Program at any time, so be sure to read the latest terms and conditions before you redeem your points.

Careem is not liable for any damages caused by the Loyalty Program. If you violate the terms of the Loyalty Program, your points may be forfeited. Separate terms and conditions may apply to rewards.


27. Careem Plus

Careem Plus is a Careem Product and Service. Careem Plus is a monthly subscription program that simplifies your life with a variety of exclusive benefits conveniently gathered under one subscription. As a User, you may be eligible to subscribe to Careem Plus, through which you may access exclusive Benefits through the Careem Platform and/or when purchasing Products and Services from Careem Technologies and/or its Partners.

The Benefits will either be automatically applied when making a transaction through the Careem Platform or you may be required to carry out extra steps to make use of a Benefit, which steps will be communicated to you by Careem from time to time.

The availability of Benefits is subject to all applicable local laws and regulations and are offered in good faith, however they may not be available and are subject to change if prohibited or restricted by applicable law or regulation.

Each Benefit may have additional terms or limitations. When redeeming Benefits made available by a Partner, separate terms and conditions will apply. In addition, separate terms and conditions will apply to any Products and Services you purchase from a Partner as part of the Careem Plus program. Please read any separate terms and conditions carefully. You agree to abide by the terms and conditions of any Partner you elect to deal with. You understand that any violation of any such Partner’s terms and conditions, or rules and restrictions, may result in you being denied access to the applicable Benefit, or Products and Services, and you losing any monies paid.

You may be given an option to subscribe to Careem Plus through in-app messaging or other digital channels (“Offer”). Each Offer may include important corresponding terms, such as the type of Benefits included in a Subscription Plan, the cost of the Subscription Charge and the Billing Cycle. It is your responsibility to ensure that you have reviewed the Offer terms before you accept and purchase a Subscription.

When you buy a Subscription Plan, you will be charged the Subscription Charge for your first Billing Cycle on the date of purchase, which activates the Benefits identified in the Offer. Careem may elect to provide you with a free trial to Careem Plus or other promotional subscriptions in which case you will be charged the Subscription Charge at the end of the trial period. If you do not wish to be charged the Subscription Charge, you must cancel the trial or promotional subscription before the end of the trial or promotional subscription. Eligibility for a free trial or promotional subscription is determined by Careem at its sole discretion.

AUTOMATICALLY (AND WITHOUT PRIOR NOTICE TO THE EXTENT ALLOWED BY LAW), YOUR SUBSCRIPTION PLAN WILL RENEW AT THE BEGINNING OF EACH BILLING CYCLE, AND THE SUBSCRIPTION PRICE WILL BE AUTOMATICALLY CHARGED TO A PAYMENT METHOD AVAILABLE IN CAREEM PAY IN YOUR ACCOUNT. If there are insufficient funds or the payment methods in Careem Pay in your User Account are declined, Careem will prompt you for a new payment method but reserves the right to terminate any unpaid Subscription Plan periods without further charge to you. Any paid Subscription Charges are non-refundable and non-transferable.

When VAT (or equivalent taxes) is in force when you buy a Subscription Plan, the Subscription Charges shall be inclusive of VAT. Where there is a future change in the VAT rate, Careem may at its discretion increase/decrease (as applicable) the Subscription Charge. When VAT (or equivalent taxes) is not in force when you buy a Subscription Plan, the Subscription Charges shall be exclusive of VAT and if VAT (or
equivalent) is later introduced, Careem may add the applicable VAT to the Subscription Charges.

You can cancel your Subscription Plan at any time prior to your next scheduled payment to avoid further charges and renewals. If you cancel your Subscription Plan, you will still have access to the Benefits until the end of the current Billing Cycle, and will not be refunded on a pro-rata basis for any cancellation initiated during a Billing Cycle. From time to time, Careem may increase the Subscription Charge, in which case you will be notified before your next Billing Cycle. If you do not wish to be charged the new Subscription Charge, you are required to cancel your subscription.

Careem and its Affiliates make no representation, and give no warranty or guarantee, either expressed or implied, and expressly disclaim all liability (including consequential damages) with respect to the availability, accuracy, timeliness, cost, quality or fitness of goods, services or products provided through Careem Plus. Careem and its Affiliates will also have no liability if any participating Partner improperly denies you the right to avail of a Benefit.

Careem Plus has no predetermined termination date and may continue until such time as Careem decides to terminate the Careem Plus program or a specific Subscription Plan. This may be at any time, with or without notice. If the Careem Plus program is terminated, Careem may refund you any unconsumed portion of your Subscription Charge without any further obligation or liability, including the availability of any Benefits after the conclusion of any notice period.

In addition, Careem reserves the right to modify the Careem Plus program, a Subscription Plan or any Benefit included in it, which changes will come into effect immediately, at your next Billing Cycle or at any other date determined by Careem. Careem may, among other things: (i) change the terms applicable to Careem Plus, including eligibility to or availability of Subscription Plans and the rules and terms that govern them; (ii) increase or decrease the number of Benefits available; and/or (iii) add or modify rules for redeeming Benefits, including blackout dates for use of Benefits.

Careem reserves the right to cancel your Subscription Plan and/or your access to Careem Plus if you appear to be using the Subscription Plan in a manner inconsistent with the terms or intent of the Careem Plus program or any portion thereof. Reasons for which Careem may cancel our Subscription Plan and/or your access to Careem Plus include, but are not limited to: (i) violation of the Terms; (ii) violation of any national,
state or local law or regulation in connection with the use of Careem Plus; (iii) commission of fraud or abuse involving any portion of Careem Plus; or (iv) action, in any other way, to the detriment of Careem Plus or any of its stakeholders; all as may be determined by Careem in its sole discretion.

Notwithstanding the foregoing, Careem Plus violations, fraud or abuse in relation to rewards points and credit, tier status or reward usage is subject to appropriate administrative and/or legal action by appropriate governmental authorities and/or by Careem including, without limitation, the cancellation of the account.


28. Dine Out

DineOut is a Careem Product and Service. It is a discovery engine that provides information about participating restaurants which you can discover the restaurants most suited to you based on your preferences.

The Help section of the Careem Platform contains information on things like: how you can sign up to Careem Plus to enable you to avail discounts at participating restaurants; the terms and conditions that apply to the discounts; how you can see the savings you have made from availing discounts through DineOut; and what you should do if you face any payment issues.

The Help section also contains contact details you can use to reach out for support in relation to the DineOut service.
